This article aims at discussing both linguistic and non–linguistic factors of the European Arrest Warrant in the legal translation process. The discussion of linguistic aspects related to the discourse analysis of the European Arrest Warrant is based on the comparative English–Polish approach to highlight the role of discourse analysis in the legal translation with an emphasis being put on faithfulness and fidelity of the legal translator. The discussion of non-linguistic factors of the European Arrest Warrant concentrates on the legal documents underlying its ontology, focus and purpose. To reach this aim, we follow the discourse methodology implemented with the systematic functional grammar analysis as well as corpus linguistic analysis. As a result, the nature and scope of the European Arrest Warrant is defined in the process of legal translation, which functions as a bridge not only between different legal systems but also between different legal languages and cultural systems.
